Terms & Conditions

For the entirety of this Terms and Conditions statement, which constitutes a legally binding contract, the following applies:

By ‘US’ or ‘WE’ we mean registered company Sparkplugs Limited. By ‘YOU’ we mean you as a private individual or the business or legal entity that you represent.

General:
In placing an order with Sparkplugs Limited you agree to the following:

  1. In line with the GDPR, you agree to our website privacy policy, a link to which can be found at the foot of all pages on our website. This details how we use and store your data.
  2. There may be special terms and conditions applied to certain items which we sell. We will advise you of these, either by including details on the relevant product page of our website or by including a written notice with the supplied goods where necessary.


Details of your order:
By law we are obliged to provide you with certain key information before a legally binding contract can be made between between you and us. Information we provide:

  1. Can be seen on the checkout page of our website.
  2. Can be seen on the confirmation of order email which we will send to you after checkout.
  3. Forms a key part of the contract between us.
  4. Must be agreed by all parties if changes are to be made to your order.


Placing your order:
A legally binding contract is made between you and us when the following applies:

  1. You successfully complete our checkout process, paying particular attention to the details and part numbers you are ordering.
  2. We will acknowledge your order via email once the checkout process is sucessfully completed and your payment has been made, however this does not confirm acceptance of your order – which may not be possible for a variety of reasons (see below).
  3. We will only accept your order once we have confirmed that none of the problems listed below apply. Acceptance of your order can only be finally confirmed when you have accepted delivery of the goods. This is to allow for the possibility of goods becoming unavailable or obsolete after the last remaining stock has been shipped to you with the potential issue of it being lost or damaged in transit.
  4. If there is a problem with your order which means that we are unable to accept it we will contact you using your provided telephone number or email.


Reasons which may prevent us from accepting you order include:

  1. Unavailability of stock
  2. Problems with your payment
  3. We are unable to sell to you or you are unable to buy from us
  4. There has been a pricing or description error.


Cancelling your order:
You have the right to cancel your order for any reason within 30 days of receipt of goods. However goods must be in the originally supplied condition, in original undamaged and unmarked manufacturer’s packaging. Goods must not have been adjusted, marked, fitted or any attempt to fit have been made. Where goods are supplied within sealed packaging (sensors, for example), the sealed inner packaging must not be opened, this constitutes contamination and means that the parts cannot be resold. By opening such packaging you must accept that you are waiving your right to cancel the order.

Returning you order:
Please contact us by email, telephone or website contact form. Your request to cancel must be made within 30 days of receipt of the goods. Please note that you are responsible for the safe return of the goods and we advise that you use a shipping service suited to the value of the goods being returned. We will not be held responsible for returned goods lost or damaged in transit.

Once we have received your returned goods we will process your return as follows:

  1. Your returned goods will be inspected and a deduction will be made for any which are not received in original condition
  2. You will be refunded in full for your original payment, less any deductions due to mishandling or packaging damage. Refunds for original shipping only apply to least cost shipping, if you chose an upgraded shipping service your refund will only be due for the least rate shipping that you were offered at the time of purchase.
  3. Refunds will be made to the account used to make the original payment. Card payments will be refunded to the card used and Paypal payments will be refunded to the Paypal account used.


Delivery of your order:
Delivery options and services are provided by Royal Mail and Fedex. A brief description of expected delivery times is provided during checkout when selecting shipping options. However this does not preclude the possibility of goods being unavailable for immediate shipment and we make no guarantees that products listed on our website are or will be available.

A tracking link will be sent via email where tracking is available for your chosen shipping service. If you have selected a non tracked service you will still receive a despatch confirmation email but without tracking link. If there is likely to be a delay in despatching your order we will contact you by telephone or email.

It is your responsibility to ensure that you have provided us with your full, correct delivery address. If you provide an incorrect delivery address and delivery cannot be made we reserve the right to cancel your order or re charge postal costs if you request that your order is re despatched with a corrected delivery address.

Payment for your order
Payments can be made by Paypal or Opayo (credit/debit card), both of which are third party payment processors offering securely encrypted payment processing. You will be passed to your chosen payment processor to complete your secure payment using their system and returned to our website for confirmation that your order has been successful. We will not be held responsible for any losses suffered as a result of breaches to Paypal or Opayo payment systems, each is responsible for its own security and for the secure handling of your payment details. We do not store or have access to your payment details.

Deferred payment
Your payment will be ‘deferred’ (Opayo) or 'Authorised' (Paypal), that is, the payment details will be authorised and the funds reserved from your balance but the charge will not be completed until we manually release the transaction and ship your order.

If we cannot accept your order
If we are unable to accept your order for any reason then any transactions will be refunded (if payment has been captured) or cancelled (if payment has not been taken) with immediate effect.

Quality of goods
In line with the Consumer Rights act 2015 you have certain legal rights where the goods we supply must:

  1. Be of satisfactory quality
  2. Be fit for purpose
  3. Match the description, sample or model


Aside from this requirement the following must be accepted:

  1. Packaging may differ from that in images
  2. Generic images may have been used for some products, in which case the product description will take precedence.
  3. All items listed on our website are sold as single items and not packages, sets or bundles unless expressly stated in the product description.
  4. Colours or other details which will not affect operation in any way may vary
  5. An alternative or equivalent part may be offered in the event of the ordered part being unavailable.
  6. End of line, new old stock or sale items will be checked to ensure that they are servicable but are essentially sold ‘as is’.


Suspected faulty goods
Before we can determine that goods are faulty we may need you to answer a number of questions or to return the goods to us for inspection by us or the original manufacturer. In the unlikely event of us supplying faulty goods or suspected faulty goods, please contact us for a resolution which may be one of the following

  1. Replacement
  2. Refund
  3. Return


Our limit of responsibility
Apart from any legal responsibility which cannot be excluded, we do not accept any responsibility for:

  1. Losses that were foreseeable to you or us upon formation of the sales contract
  2. Losses that were not due to any breach of contract on our part
  3. Business losses
  4. Losses to non consumers


Your satisfaction:
In the unlikely event of any dispute we will try to resolve the matter as quickly and efficiently as possible. This applies if you are unhappy with:

  1. The goods we have supplied
  2. The service we have provided
  3. Any other issues.

In the event of us being unable to resolve your issue we will contact you to confirm this, if you wish to take legal proceedings the relevant courts of the United Kingdom will have jurisdiction in matters relating to this contract and relevant United Kingdom law will apply.

No third party has any rights to enforce this contract, it is only you or us who has any rights on the basis of this contract.
